An explosive lawsuit filed against Fox News Network by former contributor and conservative pundit Andrea Tantaros has been thrown out of a New York court because according to Judge George Daniels the suit, "failed to plausibly allege facts tying any of the defendants to the conduct she claims caused her injury."

A spokesperson for Fox News told CNN "the decision speaks for itself."

The lawsuit accuses Tantaros' former bosses at Fox News of hacking into her work computer and cell phone. It further alleges that they used that personal information that was obtained illegally, to harass her on social media and get her suspended from Fox News in what the suit refers to as a "smear campaign." She also claimed that she was retaliated against after lodging complaints of sexual harassment against Fox News executives previously.

Tantaros previously attempted to sue the network in 2016, claiming she was sexually harassed by former network chief Roger Ailes after it was found that she was in breach of contract for publishing a book without approval.
